Product Warranty Statement

The following 10 Year performance guarantee is only applicable to Guardian LFPro Series & Guardian Series battery storage systems (Guardian LFPro 20, Guardian LFPro 25, Guardian26, Guardian38 and Guardian50) supplied by Solar Energy Australia Pty Ltd (ACN 081 639 938) (“SEA”).

Overview:
1. SEA warrants to the original purchaser (“Purchaser”) that all Guardian Series battery storage systems (“Products”) will be free from defects by reason of defective material, design, and workmanship for a period of 10 Years from the date of invoice by Solar Energy Australia.

2. Under the terms of this Warranty, the repair or replacement of the Products during the warranty period is at the option of SEA. If a replacement is supplied, warranty remains based on the original date of invoice.

3. This 10 Year Limited Warranty is subject to the terms and conditions outlined in this document, including the ‘battery warranted performance’ table.

Investigation of Claims:

1. All items, the subject of a warranty claim, must be returned to SEA for evaluation before any warranty claim is approved.

2. To make a warranty claim pursuant to this Warranty Policy, the Purchaser must:

a. contact and notify the installer of the Products or SEA within 7 days of the alleged defect first coming to the Purchaser’s notice and within the warranty period; and

b. provide SEA with the following details, including:

i. reasonable evidence of proof of purchase, such as the original sales receipt from the installer of the Products;

ii. details of the installer who installed and/or maintains the system;

iii. details of the model number and serial number(s);

iv. evidence that the product has been installed correctly and used in accordance with the operation and installation manual supplied with the Product;

v. address details of current installation and all relevant contact information;

vi. a full description of any battery fault and system information;

vii. copies of detailed battery logs within 30 days of alleged defect (downloaded via Studio PC software); and

viii. the Product available for inspection by SEA (which is at Purchaser’s cost), so that SEA may carry out any necessary work.

3. In the event a system needs to be returned for assessment under warranty, SEA will issue an RMA (Return Materials Authorisation) to track and manage this process. For further details on the RMA process, please contact Solar Energy Australia.

Conditions of Warranty:
 
This warranty extends only to: 
 
1. defects arising solely from faulty design, materials, and workmanship under the proper use of the Product, and under the following conditions: 
 
i. when installed and operated in accordance with the Installation and Operation Manual, Specifications and/or any other instructions mandated by the manufacturer of the Products;
 
ii. when installations are carried out by qualified and experienced personnel; 
 
iii. where there is no physical damage to the Product preventing its operation;
 
iv. where there is no evidence of abuse, misuse, negligence or modification; 
 
v. where the battery has been recharged within the recharge period stated on the packaging;
 
vi. where average battery temperature is less than 40°C over the functional life of the battery(noting the battery module records and averages the temperature daily and is stored on the individual battery log);
 
vii. where the battery temperature does not exceed 50°C; 
 
viii. where the battery charge voltage never exceeds 57.4 Vdc; 
 
ix. where the battery voltage never falls below 43.4Vdc;
 
x. where the maximum charge current does not exceed 50A per battery module; and
 
xi. where the Products do not meet the Battery Warranted Performance as defined below; and
 
2. Products sold by SEA or its authorized distributors or dealers and only where the Products are used and serviced within Australia; and
 
3. Products where the defects appear in the Products within the warranty period.

Battery Warranted Performance

1.The following table outlines the minimum energy throughput based on average cell temperature or 10 Years, whichever occurs first:

2. Average temperature is the average temperature measured in Degree Celsius (°C). The temperature of the internal battery module(s) is recorded at one minute intervals and averaged over the day. The average temperature over the lifetime of the battery system is calculated by adding all the average daily temperatures and dividing the sum by the number of days of operation.

3. A battery module is determined to be defective if the module fails to deliver more than 60% of its original capacity.

4. In the case a battery module is deemed to be faulty and requires repair or replacement, the replacement battery module will feature an equal or greater remaining energy throughput (Ah) than the replaced battery module.

Exclusions of Warranty:

1. This Warranty does not cover:

a. unauthorized repairs, alterations, modifications, or substitution of any parts of the Products, installation, storage or use of the Products not in accordance with the instructions supplied;

b. malfunction of the Products due to faulty installation or operation;

c. damage, defect or non-conformity caused by interworking equipment (e.g. Inverter/Charger fault);

d. Products that have their serial number or model number labels removed or defaced;

e. damage to any Third Party equipment;

f. Products purchased:

i. Not from SEA (such as purchases from unauthorized retailers and purchases over the internet, from local/international sellers or sites such as EBAY and Amazon); or

ii. Not from an authorized dealer or distributor of SEA

2. In addition to the above, this Warranty DOES NOT cover the following:

a. damage or defects to the Product that ought reasonably to have been revealed to you by and examination of the Product, where you conducted such an examination before acquiring the Product;

b. normal wear and tear of components due to the course of normal use;

c. accidental damage or damage caused by an extra ordinary event or circumstance beyond your or anyone else’s control including damage caused by:

i. environmental factors;

ii. vermin;

iii. natural discolouration of material due to ultraviolet light;

iv. crushing, impact with hard surfaces or damage caused by transit of the product;

v. foreign material, or exposure of the product to excessive heat or cold or to solvents, or water entry into the product; and

vi. abnormal product performance caused by any ancillary product interference or other external factors; or

vii. costs associated with the installation, removal, return and re-installation of any Warranty claim.

3. Freight charges both ways associated with any warranty claim are to be paid for by the Purchaser.

4. Products must be returned in the same or similar packaging from original purchase. SEA accepts no liability for loss or damage to products during transit.

Limitations of Liability:

The following statement applies if the supply of the Products to the purchaser is a consumer sale as defined under Australian Consumer Law. In this statement, ‘Our’ means ‘SEA’, ‘You’ means the ‘Purchaser’ and ‘goods’ means ‘Products’:

Our goods come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Notwithstanding the preceding clause and to the extend permissible by law, the liability of SEA is limited, in relation to the Products and at the option of SEA to:

1. Replace the Product or supply an equivalent product;

2. The repair of the Product;

3. The payment of cost of replacing the Product or of acquiring equivalent products; or

4. The payment of the cost of having the Product repaired.

To the extent permitted by law, all other warranties whether implied or otherwise, not set out in this Warranty are excluded and SEA is not liable in Contract, Tort (including, without limitation, negligence or breach of statutory duty) or otherwise to compensate the Purchaser for:

1. any increased costs or expenses;

2. any loss of profit, revenue, business, contracts or anticipated savings;

3. Any loss of business reputation or goodwill;

4. any loss or expense resulting from a claim by a third party;

5. Any special, indirect or consequential loss or damage of any nature whatsoever caused by SEA’s failure in complying with its obligations or the Purchaser’s failure due to accident, impact, misuse or negligence.

6. The benefits given to the Purchaser in this Warranty are in addition to other rights and remedies under law in relation to the Products or services to which this warranty applies.

This warranty is not applicable outside Australia.
